What Is Being Said About Habeas Corpus?

 In the first editorial in the New York Times this morning is the lead statement, “Restoring American Justice.”  I am sure all of us are affected by the story outlined in this editorial but not all of us understand why this should be.

First, our government (by this I mean our present unelected leadership) is involved with extra- or illegal activities.  In a word, our government is perpetrating unconstitutional acts.  It is doing so by resorting to disinformation and the chief object of this unconstitutional behavior and disinformation is the cover up of suspending Habeas Corpus.  This present government can certainly be accused of many other “crimes” and distortion of its mission to lead and protect the American people.  What it has done is to make a sharp distinction and withdraw the protection of Habeas Corpus in this war with other peoples and they are the ones who are unprotected by our Constitution.  The disinformation is simply that the Bush Administration (that includes all those who serve it upon appointment at the pleasure of the President) makes statements of something being so and therefore it is so. A loud constitutional raspberry would be in bad taste but entirely appropriate.

To restore American Justice for some is to impeach the President and all the President’s men.  Their modus operandi is to impede and inject themselves – sometimes violently – into public meetings with signs, catcalls and other disruptive actions. This is to embarrass the Administration and its flacks who are merely doing the job outlined for them by the President’s planners. The Republican attempt to be the only party left in the U.S. has almost worked by cowing the Democrats.  This is not quite so – or at least the last part of the above statement.  The public scenes made against this Bush Administration are messy and do not testify to thoughtful and reasoned measures that could have been and still may be taken.

The restoration of American Justice will most likely have to wait until the end of the Bush term.  The President, himself, has indicated that things will have to remain status quo – unconstitutional, disinformation and suspension of Habeas Corpus – until the end of his term when some other administration is given the reins of government.  It is sad to note that obduracy is one of the chief distinctive markings of this president.  He gets hold of a bad idea and will not let it go.

For all of those who think G.W. Bush can do no wrong or has not done anything wrong,  the problem of restoring American Justice can be explained by an Otolaryngologist who will say that the distortion of justice is not perceived as such by the backers of G.W. Bush. They must be deaf, unthinking and blind.
